This website (saigonritual.com) is operated by Saigon Ritual. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services. By visiting our site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the site.

We’ve written these Terms to be as clear as possible while still covering what needs to be covered legally. If anything is unclear, email us at hello@saigonritual.com.

1. Using Our Site

By using saigonritual.com, you confirm that:

  • You are at least 18 years old, or you are the age of majority in your state of residence
  • If you allow a minor to use the site, you accept responsibility for their activity
  • You will not use the site for any unlawful or unauthorized purpose
  • You will not attempt to interfere with the site’s security, functionality, or availability

We reserve the right to refuse service to anyone, for any reason, at any time.

2. Our Products

Accuracy

We do our best to display product colors, images, and descriptions as accurately as possible. However, we cannot guarantee that your screen’s display of any color or image will be perfectly accurate. Product photographs are for illustration purposes.

Availability & Pricing

All products are subject to availability. We reserve the right to:

  • Limit quantities sold per person or per order
  • Discontinue any product at any time without notice
  • Change pricing at any time without prior notice

Prices are listed in US Dollars (USD). Any applicable taxes are calculated at checkout based on your shipping address.

Coffee-Specific Disclosures

Our coffee products are food items intended for consumption as a beverage. They are not intended to diagnose, treat, cure, or prevent any disease. Our products contain caffeine. If you are pregnant, nursing, or have a medical condition, consult your physician before consuming our products.

Our products may contain or come into contact with allergens. Please review product descriptions and contact us at hello@saigonritual.com if you have allergy concerns.

3. Placing an Order

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order. Reasons we might cancel an order include:

  • Product unavailability
  • Errors in product or pricing information
  • Suspected fraudulent activity
  • Orders that appear to be placed by resellers or dealers

If we cancel your order, we’ll notify you at the email address on file and issue a full refund.

You agree to provide accurate, current, and complete information for all purchases, including your name, email, shipping address, and payment details.

4. Payment

All payments are processed securely through Stripe. We never see or store your full credit card number. By submitting your payment information, you authorize us to charge the applicable amount for your order, including product cost, shipping, and any taxes.

If a payment fails or is declined, your order will not be processed. We’ll notify you by email so you can update your payment information or try again.

5. Subscriptions

If you purchase a subscription, you agree to the following:

  • Recurring billing: Your payment method will be charged automatically at the beginning of each billing cycle (monthly or as specified at checkout) until you cancel.
  • Price changes: If we change subscription pricing, we’ll notify you by email at least 14 days before the new price takes effect. If you don’t cancel before the next billing cycle, you accept the new price.
  • Cancellation: You may cancel your subscription at any time by emailing hello@saigonritual.com or through your account dashboard. Cancellation takes effect before the next billing cycle — you will not be charged again after canceling.
  • Skipping shipments: You may skip a scheduled shipment by contacting us at least 3 days before your next ship date.
  • No refunds for current cycle: Once a subscription shipment has been processed and shipped, it falls under our standard return policy. We do not provide pro-rated refunds for the current billing period.

6. Shipping & Delivery

We currently ship within the United States only via USPS. For full details on shipping rates, delivery times, and our handling of delays and lost packages, please see our Shipping Policy.

Risk of loss and title for items purchased pass to you upon delivery to the carrier (USPS). Once we hand your package to USPS and provide you a tracking number, we are not responsible for delays, theft, or loss in transit — though we will work with you to resolve any issues (see our Refund & Returns Policy).

7. Returns, Refunds & Exchanges

Our return and refund terms are detailed in our Refund & Returns Policy. By placing an order, you agree to the terms of that policy.

In summary: 30-day return window for unopened items, free replacements for damaged goods, and a taste guarantee for customers who aren’t satisfied. Full details are on the policy page.

8. Intellectual Property

All content on saigonritual.com — including text, product descriptions, graphics, logos, images, photography, and website design — is the property of Saigon Ritual and is protected by United States and international copyright laws.

The Saigon Ritual name, logo, and brand marks are trademarks of Saigon Ritual. You may not use them without our prior written permission.

You may not reproduce, duplicate, copy, sell, or exploit any part of the site or its content without our express written consent.

9. User Content & Comments

If you submit comments, reviews, feedback, suggestions, or other content to us (through the site, email, or social media), you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and publish that content in connection with our business.

You agree that any content you submit:

  • Does not violate any third party’s rights (copyright, trademark, privacy, or otherwise)
  • Does not contain unlawful, defamatory, or obscene material
  • Does not contain malware, viruses, or malicious code

We reserve the right to remove any user-submitted content at our discretion. We are not responsible for the accuracy of content posted by users.

10. Third-Party Links & Services

Our site may contain links to third-party websites or services (such as Instagram, payment processors, or shipping carriers). These are not under our control, and we are not responsible for their content, privacy practices, or terms of use.

We encourage you to review the terms and privacy policies of any third-party site before engaging with it.

11. Privacy

Your use of the site is also governed by our Privacy Policy, which explains what information we collect, how we use it, and your rights. By using the site, you consent to our data practices as described in that policy.

12. Disclaimer of Warranties

The site and all products and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the site will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Limitation of Liability

To the fullest extent permitted by law, Saigon Ritual, its owner(s), employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of (or inability to use) the site or our products
  • Any errors or omissions in site content
  • Unauthorized access to your personal information
  • Any third-party conduct or content on the site

In no event shall our total liability to you exceed the amount you paid for the product or service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless Saigon Ritual, its owner(s), employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the site
  • Your violation of these Terms
  • Your violation of any third party’s rights
  • Any content you submit to the site

15. Dispute Resolution

We’d prefer to resolve any disputes informally. If you have a concern, please contact us at hello@saigonritual.com and we’ll do our best to work it out.

If we can’t resolve a dispute informally, you agree that any claim or dispute arising out of these Terms or your use of the site shall be resolved through binding arbitration in San Francisco, California, before a single arbitrator, in accordance with the rules of the American Arbitration Association.

Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis only, not as a class action or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Small claims exception: Either party may bring an individual action in small claims court if the claim qualifies.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. If you access the site from outside California, you are responsible for compliance with your local laws.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full effect.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we’ll update the “Last Updated” date at the top of this page. Changes take effect immediately upon posting. For significant changes, we may notify you by email or a prominent notice on the site.

Your continued use of the site after changes are posted constitutes your acceptance of the updated Terms.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund & Returns Policy, constitute the entire agreement between you and Saigon Ritual regarding your use of the site. They supersede any prior agreements or communications.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
